Terms of Purchase
APPENDIX ONE: Eligibility Criteria
APPENDIX TWO: ECA Acceptable Documents
Terms of Purchase:
By purchasing you agree to the following terms;
Parties
The supplier of the goods is Student Services Australia Pty Limited (SSA), ACN 100 372 156, ABN 19 100 372 156, trading as Educationsoftware.com.au. If the purchaser and the provider of payment (for example, via credit card) are different individuals, both are bound by these terms.
Eligibility
You confirm that you meet the eligibility criteria, set out in Appendix One of this agreement.
You authorise that SSA may verify your student/staff ID number with your education institution.
Education Compliance Audit (ECA)
You agree to meet the terms of the ECA, namely;
You may be chosen after purchase and delivery of your product to confirm with documentation that you meet the eligibility criteria. SSA will conduct the ECA. The ECA is separate and distinct from license conditions you may enter into with the publishers of the software purchased. SSA reserves the right to choose any or all customers to participate in the ECA at its own discretion.
Within 14 days of the ECA request, you will provide to SSA with proof of eligibility. See documentation accepted in Appendix Two, below.
ECA: Non-compliance
If you fail to comply with the ECA in the specified time, you and any third party provider of payment agree at the time of purchase, and with no further authorisation required, that you are liable for the difference between the education price you paid and the normal price. “Normal price” being the non-education price that the general public purchases the same boxed retail software for. This is quoted at the time of purchase on the educationsoftware.com.au website. If you have provided credit card details, either as purchaser or as a third party, this difference may be deducted, without further authorisation.
SSA and other parties reserve the right to commence proceedings against you for potentially making false and misleading statements, potential violation of software license conditions and other violations. If subsequent to appearing to have successfully met the ECA request it is discovered you do not meet the eligibility criteria, the ECA provides no exemption or protection from prosecution.
Academic license
The academic software license precludes the software from being used for commercial purposes.
(Except for Adobe 'Education' version)
Return or Exchange of Goods
If the plastic seal is broken a return or exchange will not be accepted due to copyright and licensing restrictions.
Please note there are no refunds or exchanges on discontinued items or where items have been superseded by a new version.
If you are returning a product that is in a resaleable condition (and the plastic seal is not broken or tampered with), then we will refund you the value of your software, minus a $25 cancellation fee to cover the costs incurred in postage, administration and labour when the software was initially sent to you. Refunds are by cheque and made payable to the name on the credit card used.
The purchaser is liable for the cost of return freight and freight insurance.
We recommend the use of Registered Post (or similar) to ensure the parcel does not get lost during transit. SSA is not liable for any lost parcels.
